A Tribunal normally comprises of one Convener and two Members. Each Tribunal is supported by a case officer who will deal with all enquiries in relation to the hearing and the progress of the case. We aim to assign the same case officer throughout the life of the reference.
Who monitors us?
Although hearings are held in private, as with all tribunals in Scotland, Additional Support Needs Tribunals for Scotland comes under the supervision of the Scottish Committee of the Administrative Justice and Tribunals Council under the provisions of the Tribunal Courts and Enforcement Act 2007 schedule 7. This requires the Scottish Committee to keep under review the constitution and working of the Tribunal, to consider and report on such matters as Tribunal hearings. Members of the Scottish Committee regularly attend Tribunal hearings and training, they then prepare a report of their observations for the committee which is also copied to the Tribunal.
How do we relate to the Scottish Government?
The Tribunals are independent of the Scottish Government, although the tribunal administration (Secretariat) is sponsored by the Support for Learning Division of the Scottish Government Education Directorate. The sponsor division provides support and advice on finance, personnel and any policy issues to the Tribunal administration. The relationship between the Scottish Government and the tribunal administration is defined in a Management Statement, which delineates responsibilities and accountability, including setting the annual budget.
How can we hear our users’ views?
In order to seek feedback from users or potential users of the Additional Support Needs Tribunals, we hold Tribunal User Group (TUG) events. During our establishment year 3 TUG events were held and these will now be held annually. The most recent TUG event took place on 30th March 2012 in Glasgow. There have been 8 TUG events and the minutes from these are in Publications.
