The 2004 Act replaces the system for assessment and recording of children and young people with special educational needs with a new framework around additional support needs. Co-ordinated support plans will be prepared for children with additional support needs, arising from complex or multiple factors, who need a range of support from different services.
The Additional Support Needs Tribunals for Scotland hears appeals, called "references", from parents and young people on certain matters relating to co-ordinated support plans.
The Tribunals' exercise of their statutory functions, decisions and dealings with its users and the public is independent of the Scottish Government and local authorities.
The new Tribunals are independent and have an expertise that equips them to hear appeals, called "references", relating to children and young people who have, or feel they should have, a co-ordinated support plan. The Tribunals are designed to operate in a user-friendly way and aim to be less intimidating for parents and children than a more formal court setting.
The Tribunals are supported by us, the tribunal administration. We gather the necessary papers for cases, arrange hearings and deal with correspondence and questions from parents and other agencies involved in the provision set out in the co-ordinated support plan
The Tribunals will be interested in what the child thinks about their education.
